Our service includes a versatile API for anyone building an AI for voice interactions, number provisioning, call handling, and a dashboard for customization and integration, such as customer service, outbound sales calls, information gathering, and surveys.

Beyond standard technical support, AKY Services Pvt Ltd offers customized professional services which include personalized consultations, advanced implementation assistance, optimization strategies, software architecture, web & mobile engineering, and more, tailored to Your specific needs. 3. Payment Terms

Payment

Information about AKY Services Pvt Ltd's service plans and solutions is available upon inquiry and proposal. Services are charged on a monthly or agreed billing cycle ("Subscription Period"). Upon signing up, You will provide AKY Services Pvt Ltd with valid billing and payment information. You authorize AKY Services Pvt Ltd to charge and/or place a hold on Your payment method with respect to any unpaid charges related to the Services.

Subscription

If You wish to cancel the Service, You must notify AKY Services or remove all subscription-based items (e.g., dedicated phone numbers, trunk channels) before the end of the current Subscription Period. Failure to do so will result in the automatic renewal of the subscription items for the next Subscription Period, and You will be responsible for the applicable fees.

Automatic Payment

You authorize AKY Services Pvt Ltd and/or any billing agent for AKY Services Pvt Ltd to charge Your payment method at the agreed schedule and to continue attempting to charge with respect to all sums described herein until such amounts are paid in full.

Late Payment Fee & Grace Period

If the automatic payment method fails, You will be issued an invoice with a 14-day due date. If the invoice remains unpaid by the due date, a 7-day grace period will be provided. AKY Services reserves the right to suspend or stop Services automatically if the payment is not received within this grace period. You agree that for amounts not paid by the due date, We may charge a late payment fee equal to the lesser of 10% of past-due amounts or the maximum allowed by law.

Service Changes

AKY Services Pvt Ltd may modify its pricing and rates from time to time with reasonable notice. The new rate will apply to Your next billing cycle after the new rates have been published or notified.

4. Acceptable Use Policy

In General

AKY Services Pvt Ltd Acceptable Use Policy constitutes an integral part of these Terms and is designed to prevent fraud and abuse of the Services and facilitate compliance with applicable laws among our Customers. Any use of the Services or any other action that disrupts the integrity of any AKY Services system or service is strictly prohibited and could result in immediate termination. You shall use the Services only for lawful purposes.

Telemarketing Compliance

You must not use the Services in violation of applicable laws governing the making and sending of calls and text messages (including TCPA, TSR, PTA regulations, local telecom rules, and DNC registries). You are solely responsible for obtaining prior express consent from recipients before initiating voice, automated, or messaging broadcasts.

Fraud Prevention and Rights of Publicity

You shall not use our Services to offer or otherwise make fraudulent goods, services, schemes, or promotions available to others, including phishing, spoofing, or deceptive caller ID practices. You must not use the voices of real individuals without proper legal consent and licensing.

5. Indemnification

You agree to indemnify, defend, and hold harmless AKY Services Pvt Ltd, its officers, directors, employees, agents, and third parties for any losses, costs, liabilities, and expenses (including reasonable attorney's fees) relating to or arising out of Your use of or inability to use the Site or Services, any user postings made by You, Your violation of any terms of this Agreement, Your violation of any rights of a third party, or Your violation of any applicable laws, rules, or regulations.

6. Warranty Disclaimer

THE SERVICES PROVIDED HEREUNDER ARE PROVIDED "AS IS" AND "AS AVAILABLE" AND AKY SERVICES PVT LTD MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. AKY SERVICES PVT LTD MAKES NO REPRESENTATIONS OR WARRANTIES THAT THE SERVICES WILL MEET CUSTOMER'S REQUIREMENTS, THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

7. Limitation of Liability

AKY SERVICES PVT LTD WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, OR DATA. OUR AGGREGATE LIABILITY UNDER THESE TERMS WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID FOR THE SERVICE THAT GAVE RISE TO THE CLAIM DURING THE 12 MONTHS BEFORE THE LIABILITY AROSE OR ONE HUNDRED DOLLARS ($100).

8. Intellectual Property Rights

In General

All rights, title, and interests in the Service, Site, and any content contained herein are the exclusive property of AKY Services Pvt Ltd, except as otherwise stated. AKY Services Pvt Ltd and its licensors own this entire website, including names, logos, trademarks, and service marks.

User-Generated & AI Content

You retain ownership of any content You submit or provide to the Site or Service. By submitting User Content, You grant AKY Services a non-exclusive license to use and process such content as necessary to deliver the Service.

9. Call Recording & Third-Party Vendors

If You enable call recording or AI voice features, You give AKY Services Pvt Ltd permission to process and record communication data for providing analytics, transcription, and improving models included in the Service. Before being used for platform improvement, data is de-identified and aggregated in compliance with applicable standards.

10. DMCA Policy

AKY Services Pvt Ltd respects the intellectual property rights of others. If You believe that Your copyrighted work has been infringed, please send a notice containing relevant details to our team at privacy@akyservice.com.

11. Modifications to Terms

AKY Services Pvt Ltd reserves the right to modify these Terms at any time. Updated versions of the Terms will be posted on this page and are effective upon posting. Continued use of the Site or Services constitutes Your acceptance of the updated terms.

12. Dispute Resolution

For all disputes, You must first give Us an opportunity to resolve Your claim through good-faith negotiation. Both parties agree that any formal proceedings will be conducted on an individual basis and waive any class action or jury trial rights to the maximum extent permitted by law.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms remain in full force and effect.

14. Assignment

You may not transfer or assign this Agreement or any rights under it without our prior written consent. AKY Services Pvt Ltd may assign this Agreement or rights thereunder in connection with a corporate reorganization, merger, or asset sale.

15. Force Majeure

Neither party shall be liable for any default or delay in the performance of its obligations (excluding payment obligations) caused by acts beyond reasonable control, including natural disasters, internet infrastructure outages, acts of war, civil disorders, or government actions.

16. Enforcement and Waiver

AKY Services Pvt Ltd has the right to monitor and enforce compliance with this Agreement. Failure by AKY Services to enforce any right or provision in one instance shall not constitute a waiver of such right or provision in any subsequent instance.
